The PSA TRUCKS “Ram 1500” giveaway (“Sweepstakes”) is SPONSORED BY Performance Sales & Accessories (“SPONSOR”) AND ADMINISTERED BY Performance Sales & Accessories. (“ADMINISTRATOR”). Sweepstakes BEGINS ON May 1st, 2019 AT 12:00:01 a.m. Eastern Time (“ET”) AND ENDS ON September 7th, 2019 AT 1:30:00 p.m. ET. (“SWEEPSTAKE PERIOD”). The Sponsor’s database computer is the official time-keeping device for the Sweepstakes.
NO PURCHASE OR PAYMENT OF MONEY IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE OR PAYMENT OF MONEY WILL NOT IMPROVE THE CHANCES OF WINNING.
Two Methods to Enter
1). Online/In Store Purchase Entry: Eligible Entrants who purchase online or in store at performanceaccessories.ca or 28 Farnham Rd Belleville ON will receive one (1) “Sweepstakes” entry for each $5.00 of merchandise purchased (Including tax Excluding shipping). “merchandise” includes hats, stickers, shirts and flags. Participant will be required to provide: first and last name, home address, telephone number, and e-mail address. All online entries must be received by 11:59:59 p.m. ET on September 6th, 2019. Proof of entering information at the Website is not considered proof of delivery to or receipt by Sponsor of an entry. Internet entries must be made by the Entrant only at the Website. Entries made by any other individual or any entity, and/or originating at any other web site or email address, including, but not limited to, commercial Sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes. The use of automated entry devices is prohibited, and no mechanically reproduced entries are allowed; all such entries are void.
NOTE: “ANY FRAUDULENT ACTIVITY IN CONNECTION WITH THIS PROMOTION IS STRICTLY PROHIBITED. IT IS FRAUDULENT TO PURCHASE ITEMS TO OBTAIN ENTRIES WITH THE INTENT TO RETURN THESE ITEMS AFTER THE PROMOTION. IF THE SPONSOR IDENTIFIES OR SUSPECTS THAT YOU ARE ENGAGED IN THIS OR ANY OTHER FRAUDULENT ACTIVITY, YOU WILL BE DISQUALIFIED AND BANNED FROM ANY FURTHER SWEEPSTAKES OR PROMOTIONS OFFERED BY THE SPONSOR.”
2). Mail-in Entry: Eligible Entrants also have the option to obtain one (1) Sweepstakes entry via mail by legibly hand-printing, on a 3”x 5” card or paper, their full name, complete mailing address, phone number, and e-mail address, and mailing the card in a #10 envelope, with proper postage affixed, to: Performance Sales, 28 Farnham Rd Belleville ON K8N4Z5. Each mail-in entry must be mailed separately. All entries must be received by September 5th, 2019 to be eligible.
NOTE: Mail-in entry card and envelope must be hand printed by the Entrant only. In addition, Entrants are not permitted to use any 3rd party organization to assist with the entry process in any way (as determined by the ADMINISTRATOR). Each Envelope must be mailed individually. Bulk shipments of entries will not be accepted.
By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and Administrator. Void where prohibited by law.
ELIGIBILITY: The Sweepstakes is open to legal residents of Canada & USA. Forty eight (48) United States (excludes Hawaii and Alaska) and the District of Columbia, as well as residents of Canada (except Province of Quebec), who are eighteen (18) years of age or older (exceptions-must be 19 years of age or older for those that reside in provinces of British Columbia, New Brunswick, Newfoundland, and Nova Scotia, and Northwest Territories, Nunavut and Yukon, and states of Alabama, Nebraska, and 21 years of age or older in state of Mississippi) as of the date of entry. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Participation constitutes Participant’s full and unconditional agreement to these Official Rules and Sponsor decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Void in Hawaii, Alaska, Province of Quebec, Puerto Rico, the U.S. Virgin Islands, Guam, U.S. Military installations in foreign countries, and where prohibited, taxed, or restricted by law, regulation or ordinance.
Employees, officers and representatives of the Sponsor, the Administrator and their respective parent companies and members of their immediate families (defined as including spouse, biological, adoptive and step-parents, grandparents, siblings, children and grandchildren, and each of their respective spouses, regardless of where they reside) or households (whether related or not) of any of the above are NOT eligible to participate in this Sweepstakes. Non-eligibility or non-compliance with any of these Official Rules will result in disqualification.
Sweepstakes winner will be chosen at random using the SWEEPSTAKES BALLOT BOX. The odds of winning will depend on the number of entries received. The winner will be first reached through phone call. If not reached will be sent an email. The winner will have 30 days to respond. If no response is received within 30 days, another winner will be drawn. Administrators are not responsible for prize fulfillment nor for any technical failures. Winning entry will be verified. The giveaway winner will be displayed on our website.
The Winner must possess automobile insurance prior to receiving prize. Any costs associated with registration and licensing of the automobile are the sole responsibility of the Winner. No substitution or transfer of Prize will be permitted, except by the Sponsor, who reserves the right at its sole discretion to substitute a Prize with another Prize of equal or less value. All other expenses associated with Prize acceptance not mentioned herein are the sole responsibility of the Winner. (ie Taxes due in own province/territory/state. Shipping & duty fees)
The GIVEAWAY Winner (“Winner”), upon the Administrator’s confirmation of eligibility, will receive a 2016 Dodge Ram 1500 regular cab short box 4×4 that has an approximate retail value (“ARV”) of $30,000.00
The value of the Prize set forth above represents Sponsor’s good faith determinations of the ARV thereof and such determinations are final and binding and cannot be appealed. If actual value of a Prize is lower than the stated ARV when Prize is procured and fulfilled, then the difference will not be awarded. All other expenses associated with Prize acceptance or usage not specifically mentioned herein are the responsibility of the Winner.
Note: The WINNER must travel to 28 Farnham Rd Belleville ON (the “Location”) to take possession of the GIVEAWAY Prize. Any expense incurred by winner for travel & delivery of Sweepstakes is solely the responsibility of the said winner. The Sponsor will not provide any compensation to the WINNER for travel to claim the Sweepstakes prize.
RELEASE AND LIMITATIONS OF LIABILITY: By participating in the GIVEAWAY, Entrants agree to release and hold harmless the Released Parties from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any Prize, including, but not limited to: (i) any technical errors that may prevent an Entrant from submitting an entry; (ii) unauthorized human intervention in the GIVEAWAY; (iii) printing errors; (iv) errors in the administration of the GIVEAWAY or the processing of entries; or (v) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the GIVEAWAY or receipt of the Grand Prize. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to Entrant’s or any other person’s computer relating to or resulting from participation in this GIVEAWAY or downloading any materials in this GIVEAWAY. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the GIVEAWAY, and in no event shall the Released Parties be liable for attorney fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
Residents of Canada will be required to enter a skill-testing question to claim their prize.
Administrator and sponsor reserve the right to publish winner’s first and last name along with a picture of them with the Sweepstakes Prize.
